    By accessing or using this website, creating an account or placing an order, you agree to the applicable provisions of these Terms and Policies.

    Hereinafter referred to as “BRATJÉ”, “81CAP”, “we”, “us” or “our”.

    PART I – TERMS AND CONDITIONS

    2. Scope

    These Terms and Conditions apply to the use of www.81cap.com and to purchases made through the website.

    They apply to both consumers and business customers unless a particular provision expressly applies only to consumers.

    A consumer is a natural person acting for purposes outside their trade, business or professional activity.

    A business customer is a natural or legal person purchasing products in connection with their trade, business or professional activity.

    Mandatory consumer rights provided by Slovenian and European Union law are not affected by these Terms.

    3. Products

    81CAP offers spray caps, spray accessories and related products.

    We make reasonable efforts to ensure that product descriptions, photographs, dimensions, specifications and other information displayed on the website are accurate.

    Minor variations in colour, appearance, finish, dimensions or packaging may occur as a result of manufacturing processes, product improvements, screen settings or photography.

    Product images are illustrative unless expressly stated otherwise.

    We reserve the right to improve or modify products where such changes do not materially reduce the functionality or quality of the product ordered.

    4. Product use

    Customers are responsible for using products in accordance with their intended purpose and any instructions provided with the product.

    81CAP spray accessories may be used with aerosol products manufactured by third parties.

    Compatibility may depend on the aerosol can, valve, paint or other substance used.

    Unless expressly stated otherwise, BRATJÉ does not manufacture or control the contents of third-party aerosol cans and is not responsible for defects or damage arising solely from incompatible, defective or improperly used third-party products.

    Products must be used responsibly and in accordance with applicable local laws, safety instructions and manufacturer instructions.

    5. Ordering

    Products can be ordered through www.81cap.com.

    Before submitting an order, the customer will have the opportunity to review and correct the information entered.

    By submitting an order, the customer confirms that:

    • the information provided is accurate;
    • they are legally capable of entering into the purchase agreement;
    • they agree to the applicable Terms and Conditions;
    • they agree to pay the total amount displayed before placing the order.

    An automated acknowledgement that we have received an order does not necessarily constitute acceptance of the order.

    A purchase agreement is concluded when we accept the order and send an order confirmation or otherwise begin fulfilling the order.

    We reserve the right to reject or cancel an order where there is a legitimate reason, including:

    • a product being unavailable;
    • an obvious pricing or technical error;
    • suspected fraud or misuse;
    • incorrect customer information;
    • payment failure;
    • legal or regulatory restrictions preventing delivery.

    If payment has already been received for an order that we cannot fulfil, the amount paid will be refunded.

    6. Prices

    Prices are displayed on the website in the currency indicated.

    For consumers, prices are displayed inclusive of VAT where applicable unless clearly stated otherwise.

    Delivery costs and any other applicable charges will be displayed before the customer completes the order.

    For orders delivered outside the European Union, the customer may be responsible for import duties, customs charges, local taxes or other fees imposed by the destination country unless the checkout or specific sales agreement expressly states that such costs are included.

    Customers are responsible for checking applicable import requirements in their country.

    We may change prices at any time. Price changes do not affect orders that have already been accepted.

    In the event of an obvious pricing error, we may contact the customer before accepting the order.

    7. Payments

    Available payment methods are displayed during checkout.

    Depending on the market and order, payment methods may include payment cards, electronic payment services, bank transfer or other payment methods made available by us.

    Payments may be processed by third-party payment providers.

    BRATJÉ does not normally receive or store complete payment-card information where the payment is handled directly by an authorised payment provider.

    An order may be held until payment has been successfully authorised or received.

    8. Delivery

    Orders may be delivered using our selected shipping and logistics partners, including:

    • Pošta Slovenije
    • GLS
    • DHL

    The shipping provider used for a particular order may depend on:

    • destination;
    • parcel size and weight;
    • selected delivery option;
    • availability;
    • commercial shipping conditions.

    Available delivery methods, destinations, prices and estimated delivery times are displayed during checkout or otherwise communicated before the order is confirmed.

    We aim to dispatch and deliver orders within the estimated period indicated.

    Unless another delivery period has been agreed, orders to consumers will be fulfilled without undue delay and within the period required under applicable consumer law.

    Delivery dates are estimates unless expressly agreed as guaranteed.

    Delays may occur due to circumstances outside our reasonable control, including:

    • customs procedures;
    • transportation disruptions;
    • adverse weather;
    • strikes;
    • supply disruptions;
    • events of force majeure.

    The customer is responsible for providing a complete and accurate delivery address.

    Additional costs resulting from an incorrect or incomplete address supplied by the customer may be charged to the customer where legally permitted.

    9. Transfer of risk

    For consumer purchases, risk of loss or damage passes to the consumer when the consumer, or a third party designated by them other than the carrier, physically receives the goods, except where applicable law provides otherwise.

    For business purchases, risk may pass in accordance with the delivery terms agreed between BRATJÉ and the business customer.

    10. CONSUMER RIGHT OF WITHDRAWAL

    Consumers purchasing goods online generally have the right to withdraw from the purchase agreement without giving a reason.

    The withdrawal period is 14 days.

    For goods, the withdrawal period generally begins on the day on which the consumer or a third party designated by the consumer receives the goods.

    Where several goods forming one order are delivered separately, the period generally starts when the last item is received.

    11. How to withdraw

    To exercise the right of withdrawal, the consumer must clearly inform us of the decision to withdraw before the withdrawal period expires.

    Where an online withdrawal function is provided on www.81cap.com, consumers may also use that function.

    It is sufficient for the consumer to send the withdrawal notice before the 14-day period expires.

    13. Returning products after withdrawal

    After notifying us of withdrawal, the consumer must return the products without undue delay and within the legally prescribed period.

    Unless we agree otherwise or applicable law requires otherwise, the consumer bears the direct cost of returning goods following a change-of-mind withdrawal.

    The consumer may inspect and handle the product only to the extent necessary to determine its nature, characteristics and functioning.

    The consumer may be responsible for diminished value resulting from handling beyond what would normally be necessary to inspect the product.

    14. Refunds following withdrawal

    Where a valid consumer withdrawal is exercised, we will reimburse payments received from the consumer, including the cost of standard delivery where required by law.

    If the consumer selected a delivery method more expensive than the least expensive standard delivery method offered, we are not required to refund the additional delivery cost.

    Refunds will normally be made using the same payment method used for the original transaction unless otherwise agreed.

    We may withhold reimbursement until we have received the returned goods or the consumer provides evidence that the goods have been sent back, whichever occurs first, where permitted by law.

    15. Exceptions to the right of withdrawal

    The right of withdrawal does not apply in circumstances excluded by applicable consumer law.

    These may include, among others:

    • goods made according to the consumer's specifications or clearly personalised;
    • goods that deteriorate or expire rapidly;
    • sealed goods that are not suitable for return for health or hygiene reasons where the seal has been broken after delivery;
    • goods which, because of their nature, become inseparably mixed with other items after delivery;
    • other cases expressly excluded by applicable law.

    These exceptions apply only where the legal requirements for the relevant exception are satisfied.

    16. CONFORMITY, DEFECTIVE PRODUCTS AND CONSUMER RIGHTS

    BRATJÉ is responsible for ensuring that goods supplied to consumers conform to the purchase agreement as required by applicable law.

    Under applicable Slovenian and EU consumer protection rules, the seller is generally responsible for a lack of conformity that existed at the time of delivery and becomes apparent within the applicable statutory period.

    If a product is not in conformity with the agreement, the consumer may have the right to request that the product be brought into conformity, normally by:

    • repair; or
    • replacement,

    free of charge and in accordance with applicable law.

    Where the product cannot be brought into conformity within the legally required period, or where other legal conditions are met, the consumer may be entitled to:

    • an appropriate reduction in price; or
    • termination of the purchase agreement and reimbursement.

    These statutory rights are separate from the 14-day right of withdrawal.

    Nothing in these Terms limits mandatory consumer rights.

    18. BUSINESS CUSTOMERS

    The statutory 14-day consumer right of withdrawal applies to consumers and does not automatically apply to purchases made by businesses or professionals.

    Separate quotations, distributor agreements, wholesale agreements or other written commercial agreements may contain additional or different conditions.

    Where there is a conflict between these Terms and a separately agreed written B2B agreement, the separately agreed terms will prevail to the extent of that conflict.

    19. User accounts

    Certain services may require an account.

    Users are responsible for maintaining the confidentiality of their account credentials and for activities conducted through their account.

    Users must notify us if they reasonably believe that their account has been accessed without authorisation.

    We may suspend or terminate an account where necessary because of:

    • misuse;
    • fraud;
    • security concerns;
    • violation of these Terms;
    • legal requirements.

    20. Intellectual property

    Unless otherwise stated, all content on www.81cap.com, including:

    • trademarks;
    • logos;
    • product names;
    • product designs;
    • photographs;
    • videos;
    • graphics;
    • illustrations;
    • text;
    • website design;
    • technical drawings;
    • product descriptions;

    is owned by or licensed to BRATJÉ and is protected by applicable intellectual property laws.

    The names 81CAP, 81X360 and associated branding, designs and visual materials may not be reproduced, distributed, modified or commercially exploited without prior permission where such use is protected by applicable law.

    Nothing on the website grants users ownership of any intellectual property rights.

    21. Website use

    Users may not use the website:

    • for unlawful purposes;
    • to interfere with website security;
    • to attempt unauthorised access to systems or accounts;
    • to distribute malicious software;
    • to fraudulently obtain products or services;
    • to infringe intellectual property or other rights;
    • to scrape or systematically extract website content for commercial use without permission where prohibited by law.

    22. Availability of the website

    We aim to keep www.81cap.com available and operational but cannot guarantee uninterrupted or error-free access.

    We may temporarily suspend or modify the website for:

    • maintenance;
    • security;
    • technical upgrades;
    • operational reasons.

    23. Liability

    Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law.

    To the extent permitted by law, BRATJÉ is not liable for indirect or consequential losses arising from circumstances outside its reasonable control.

    For business customers, additional limitations of liability may be agreed separately.

    Mandatory consumer rights remain unaffected.

    24. Force majeure

    BRATJÉ will not be responsible for failure or delay in performing obligations where the failure or delay results from circumstances outside our reasonable control.

    Such circumstances may include natural disasters, war, civil disturbance, government actions, transport disruption, strikes, epidemics, interruptions in energy or telecommunications services, major supply-chain disruptions or similar events.

    25. GOVERNING LAW

    These Terms and contracts concluded through www.81cap.com are governed by the laws of the Republic of Slovenia, subject to any mandatory consumer protections provided by the laws applicable to the consumer.

    For consumers residing in another EU Member State, this choice of law does not deprive the consumer of mandatory protections that cannot legally be excluded under the law of their country of residence.

    Any disputes will be handled by the courts having jurisdiction under applicable law.

    26. ALTERNATIVE DISPUTE RESOLUTION

    We encourage customers to contact us first at info@81cap.com so that complaints can be resolved directly whenever possible.

    Where required by applicable Slovenian legislation, information regarding available out-of-court consumer dispute resolution will be made available to consumers.

    The former European Commission Online Dispute Resolution (ODR) platform is no longer operational.

    Where such technologies require consent, they will not be activated for a visitor until the required consent has been obtained.

    For shipping and delivery, we currently use or may use:

    34. Shipping information

    To fulfil and deliver orders, BRATJÉ may share necessary customer information with Pošta Slovenije, GLS or DHL, depending on the delivery method and destination.

    This information may include:

    • name and surname;
    • company name where applicable;
    • delivery address;
    • telephone number;
    • email address;
    • parcel and delivery information;
    • information required for customs documentation for international shipments.

    Shipping providers process this information for purposes such as:

    • parcel collection;
    • transportation;
    • delivery;
    • delivery notifications;
    • tracking;
    • customs procedures where applicable;
    • handling delivery-related enquiries.

    The selected carrier may process certain data in accordance with its own legal obligations and privacy policies.

    35. Payment information

    Payments may be processed through independent payment providers.

    Where a payment provider collects payment information directly, that provider may act as an independent controller or processor for certain data in accordance with its own privacy terms.

    BRATJÉ generally does not store complete payment-card details where these are processed directly by the payment provider.

    36. International transfers

    Some service providers may process personal information outside Slovenia or outside the European Economic Area.

    Where personal data is transferred to a country outside the EEA that does not benefit from an applicable adequacy decision, we will use an appropriate legal transfer mechanism where required, such as:

    • another legally recognised safeguard.

    37. How long do we keep your data?

    We retain personal data only for as long as necessary for the purpose for which it was collected and for any additional period required by law.

    For example:

    • account data may be retained while the account remains active;
    • order and invoice information may be retained for the period required under tax, accounting and commercial law;
    • correspondence may be retained for as long as necessary to handle the relevant enquiry or protect legal interests;
    • marketing information may be retained until consent is withdrawn or the information is no longer required.

    After the applicable retention period expires, personal data will be deleted, anonymised or otherwise securely disposed of where appropriate.

    Access to personal information is limited to persons who require such access for legitimate business purposes.

    However, no internet transmission or electronic storage system can guarantee absolute security.

    42. Children

    Our online shop and services are not specifically directed at children.

    Persons who are not legally permitted to enter into a purchase agreement should not make purchases without the involvement of a parent, guardian or other authorised person.

    We do not knowingly seek to collect personal information from children where parental or guardian consent would be legally required.
